County Health Departments Collecting ID’s For the Right Reasons, Unlawfully?

When a person needs to upgrade their drivers license to the real ID or simply get a state-issued ID they must show a certified birth certificate. Most people would say no problem just go back to the county in which you got one and get one. For some people thats not as easy as it would seem.

If you go to your local county health department to get a copy of your birth certificate they will ask you for ID. How do you provide that if you cant get it because getting an ID is contingent on getting your birth certificate? So now what do you do? That seems like it violates your right to due process. That’s a great question however, I have the answer.

Let me explain first that them asking for ID to get vital records is a matter of security and that can be another article. Under Indiana State Statute however, we find that a health officer obtaining ID to issue you your own birth certificate could be unlawful. IC: 16-37-8-1(a) states that ID is required but an exception is made if it’s own own certificate that you are requesting.

Further evidence was obtained by going to vitalrecords.com and requesting a birth certificate for myself in LaPorte County. So long as you answer the questions presented to you correctly then you do not need to provide ID. This is to help with liability claims in case a certificate is obtained by someone that is not you trying to skirt the lawful process and not because it is required.

How did we get to the point were policy is dictated outside of the law instead of changing the law? What do we do from here and why will we have to fight to stop the enforcement of an unlawful policy until said time in which it becomes lawful?
